02Categories of Personal Data Processed

The personal data we may process falls under the following categories:

  • Identity data: first and last name, Turkish national ID number, date of birth.
  • Contact data: email address, phone number, postal address.
  • Client/Supplier transaction data: company information, project details, contract details, invoice and payment information.
  • Website traffic data: IP address, cookie data, visit date/time, browser information.
  • Personnel/candidate data: CV, education information, professional experience.

03Purposes of Processing

Your personal data is processed for the following purposes:

  • Evaluation of quote requests and management of contracting processes.
  • Communication with clients, suppliers and business partners.
  • Delivery of construction and contracting projects.
  • Compliance with legal obligations (tax, social security, public-procurement legislation, etc.).
  • Operating and improving the functionality of our website.
  • Running our human-resources processes and evaluating candidates.

04Legal Basis for Processing

Your personal data is processed on the legal bases set out in KVKK Articles 5 and 6, namely:

  • Your explicit consent (KVKK Art. 5/1).
  • Necessity for the establishment or performance of a contract (KVKK Art. 5/2-c).
  • Necessity for compliance with a legal obligation (KVKK Art. 5/2-ç).
  • Necessity for the establishment, exercise or protection of a right (KVKK Art. 5/2-e).
  • Necessity for our legitimate interests, provided your fundamental rights and freedoms are not harmed (KVKK Art. 5/2-f).

05Transfer of Personal Data

In line with KVKK Articles 8 and 9, your personal data may be shared, only within the purposes set out in this Notice, with:

  • Authorised public authorities and institutions (tax offices, social security, courts, etc.) within the scope of legal obligations,
  • Our subsidiaries (İN-TES SRL — Romania, MEKA LTD. — Bulgaria, Elit İnşaat LTD. — Russia) for the execution of international projects,
  • Professional service providers we engage such as accountants, independent auditors and legal counsel,
  • Suppliers that operate our IT infrastructure.

Cross-border transfers are made only where the destination country provides an adequate level of protection or where your explicit consent has been obtained.

06Retention Period

Your personal data is retained for as long as required by applicable legislation or as necessary for the purposes for which it is processed. At the end of this period, your personal data is deleted, destroyed or anonymised.

Retention obligations under the Turkish Tax Procedure Law, the Turkish Commercial Code and the Labour Law (minimum 5–10 years) apply with priority.

07Rights of the Data Subject (KVKK Art. 11)

Under KVKK Article 11, as a data subject you have the right to:

  1. Learn whether your personal data is being processed.
  2. Request information if your personal data has been processed.
  3. Learn the purpose of processing and whether the data is used in accordance with that purpose.
  4. Be informed about third parties to whom data has been transferred, in Türkiye or abroad.
  5. Request correction of personal data that is incomplete or inaccurate.
  6. Request erasure or destruction of personal data under the conditions of KVKK Art. 7.
  7. Request that corrections, erasures and destructions be communicated to the third parties to whom the data has been transferred.
  8. Object to outcomes adverse to you arising from the analysis of processed data exclusively by automated systems.
  9. Claim compensation for damage suffered as a result of unlawful processing of personal data.

08How to Exercise Your Rights

To exercise the rights set out above, you may submit your request in accordance with the Communiqué on Application Procedures to the Data Controller through one of the following channels:

  • By post: in writing, to H. Halil St., 1210 Lane No: 6, Gebze · Kocaeli / Türkiye.
  • By email: to info@atahaninsaat.com.tr via registered electronic mail (KEP) or a secure electronic signature.

Your application is resolved free of charge within at most 30 (thirty) days. If the process requires additional cost, a fee may be charged according to the tariff set by the Authority.
